New York Workers Compensation Lawsuits

According to the US Bureau of Labor Statistics, more than 4 million workers received injuries on the job during 2005 and 5,700 workers lose their lives from work-related accidents and injuries.

New York City's (NYC) no-fault worker's compensation program provides for financial protection to workers who get hurt on the job and also, provides them appropriate medical attention.

New York State laws require employers to buy insurance that will provide compensation benefits to their employees in case of an injury on the job. This insurance covers required medical care expenses and recovers lost wages. It provides medical treatment facilities but, if you are about to file an injury claim, then the process can be quite tedious. Most injury cases are handled by a third party insurer (that excludes the State) that will try its best to devoid you of injury claim.

If your injury claim is denied, reduced or terminated, then you are allowed to have a hearing before a law judge. The other side will also hire a strong defense attorney to try their best to make your injury claim amount void and if you are faced with a similar situation, then you must get in touch with your workers compensation lawyer to help you get justice and compensation from the negligent party involved.

Workers injury compensation claim covers several injuries, which includes carpal tunnel syndrome, back problems, stress-related problems, mental health issues, heart attacks, illnesses or strokes that could have resulted from inferior safety and health facilities at your workplace. It can include post-traumatic stress disorders and other injuries that the victim has suffered on the job.

If you are employed by a covered NY employer then you can avail the benefits of workers compensation and it should be your top priority to insure the safety of the employees; your employer should provide its employer with adequate medical aid and attention in case of an accident at the workplace. You would be eligible for workers compensation irrespective of the fact if you work full-time, part-time, temporary or are working as any other undocumented worker.

If you have ever been a victim of personal injury due to negligence of your employer within the New York City, then you can consult a New York workers compensation law firms. Your workers compensation attorneys will help you receive workers compensation benefits like Social Security Disability, Supplemental Short-Term Disability, Long-term Disability, New York State and New York City Retirement Disability and other programs.

Most of the workers compensation lawyers work on contingency basis. Therefore, you don't have to spend anything before contacting a workers compensation law firm in New York City (NYC).

Czech Food and Drink - The Top Five Czech Restaurants in America

Are you craving some hearty, satisfying Czech style cuisine but you're nowhere near the Czech Republic? Never fear... here are five inviting, authentic restaurants in America where you can sample the finest Czech style food and drink...

Although there are millions of people of Czech descent in the United States, Czech restaurants aren't particularly common. We are not sure why, because the cuisine is some of the most satisfying and delicious you'll ever find at a dinner table.

Pork, beef, dumplings, and home made desserts are key elements of a Czech style dinner. The meat is prepared in a variety of ways, from hearty stews and soups to baked or pan breaded. In several heritage communities across America, you'll find a few gems, just waiting for you to stop by.

In no particular order, here is a list of five of our favorites:

Milan's Restaurant: Brooklyn, New York

Milan's doesn't look like much from the outside, but once inside you are transported to central Europe. The comfortable and traditional decor melds well with the lovingly prepared meals.

You can also buy authentic packaged goods from Slovakia and the Czech Republic here, including bottled beer, soda, and grocery items.

Our favorites here? Cabbage soup with smoked meat, roast pork with sauerkraut and dumplings, all washed down with one of the four Czech beers on the menu.

Cafe Bohemia: Omaha, Nebraska

Just a mile south of the Old Market district in downtown Omaha is Cafe Bohemia. This cozy restaurant has been serving authentic cuisine since the 1920's, at very reasonable prices. You won't go home hungry, that's for sure!

Cafe Bohemia is a great place to try swieckova, a sauerbraten style dish usually served with dumplings or potato pancakes. But if you're not sure, don't worry. The friendly, experienced waitresses will steer you in the right direction.

Klas Restaurant: Cicero, Illinois

The largest Czech restaurant in the United State, Klas has greeted diners since 1922. It is only open Thursdays through Sundays. The large interior room is decorated with original antiques and assorted treasures directly from the Czech Republic.

We like coming here for lunch. Lunches are served Bohemian style, with soup, salad bar, entree, two sides, and dessert. Cicero is a near west suburb of Chicago, about 20 minutes from downtown.

Moldau Restaurant: Brookfield, Illinois

A staple in the thriving west suburban Chicago Czech community, this is another comfort food gem. It is located on Ogden Avenue, about 10 minutes west of Klas Restaurant.

Moldau is a small, quaint place that does brisk business on Sundays. Come here for the roast duck and home made desserts.

Czech-Tex Restaurant: Snook, Texas

Like Chicago, south central Texas also has a large Czech heritage community. The little town of Snook, about ten miles from College Station, boasts Czech-Tex, kind of combination barbecue and old world place that dished up traditional dishes to your hearts content.

Every day, you will find the chicken and dumpling special on the menu. Pot roast, grilled pork chops, and smoked prime rib are other favorites.

Summary

Are you hungry yet? If so, head to one of these authentic Czech style restaurants for traditional central European style food in a warm and friendly atmosphere.

A Medical Malpractice Victim's Guide to Compensation in New York - Part 2

A verdict allows a victim to 'enter judgment' against the doctor or hospital for the amount that has been awarded. In addition to the award, interest will be added to the award for past pain and suffering from the time of the malpractice until the date of the verdict.

Once a judgment is entered, the attorney can make every effort to collect against the doctor, hospital or its' insurance company.

Elements of compensation:

1. Pain & suffering

2. Economic loss

(a) Medical & hospital bills

(b) Lost wages

(c) Lost future income

(d) Lost benefits

(e) Lost future benefits

(f) Future medical expenses, including doctors, hospitals, surgery, rehabilitation, medical insurance premiums, nursing, medications & medical equipment.

Pain & Suffering

A settlement for pain and suffering is based on what other similar cases have settled for. Many times your lawyer can determine what 5 days of suffering is worth in the County in which you have your case. They can try and find similar cases and injuries to what you experienced to get a sense of the value of your particular case.

Having said that, it's important to note that every case is different, and every person who suffers an injury handles it differently. That's why there's such great fluctuation between similar cases, especially in different parts of the State. A jury in upstate Albany County may view a fractured arm as having a lower value than a jury in Manhattan or the Bronx.
Importantly, pain and suffering awards are tax-free in New York.

Economic Loss

This is an element of 'damages' that is readily calculated. If the victim was working, we can piece together what they were earning at the time of the malpractice, and then project forward what they likely would have earned in the future had they not suffered such horrible injuries.

In order to help a jury understand the value of money, medical malpractice lawyers will often hire economists, experts at evaluating and discussing the value of money. We all know that the value of a dollar 20 years ago was much different than it is today. That's known as inflation. An expert economist is brought in to explain to a jury that a dollar today will not buy the same things 10, 15, 20 and even 30 years from today. That is why when we ask a jury to make an award today, they must recognize that this award will be used to help pay for medical expenses for the rest of that victims' life. If an award is made to pay for something that costs $100 dollars today, in 15 years that same $100 will not be able to buy the medical device that he used to buy it 15 years earlier. it would not be fair to the victim or his family to dig into their own pockets to pay for those expenses, especially when they did nothing to contribute to the victim's injuries. It should be the total responsibility of the person who caused the harm.

To determine what medical expenses are likely to be incurred in the future, medical specialists are brought in to discuss the victim's injuries and what they can expect to happen in the future. We often include rehabilitation experts, and vocational experts to explain what type of employment this handicapped individual might be capable of doing in the future, and what kind of income they could ever be expected to earn.

Conclusion

These are the basics to understanding how a medical malpractice victim obtains full and fair compensation in the State of New York.

Window Gates - A Glance At New York's Windows And Gates

As a young man I lived all over Brooklyn and Manhattan. I stayed three years in a brownstone in Cobble Hill, four years on the Upper West Side, and 15 in a SoHo loft. Even after moving away I came back to work in the city for six summers, sharing apartments in midtown, the West Village, and Tribeca. In every neighborhood, I spent a lot of time walking and cycling the streets and enjoying the city's people, stores and restaurants, and most of all, its amazing buildings.

Now that I spend most of my time in the country, I miss one feature of New York buildings that just doesn't show up in most other places - window gates. They decorate brownstones, surround air conditioners, keep children from falling out of highrises and, softened by bright red geraniums and draping green ivy, protect tens of thousands of New Yorkers from break-ins and burglaries. They even add a certain elegance to the glazed-white-brick apartment houses that everyone loves to hate in east midtown.

They didn't always strike me that way. When I first moved to the city I perceived them as bars, not gates. The only barred windows I'd ever seen were in prisons, and those were clearly designed to keep people in, not out. I pitied the people who lived behind them.

But like many attributes of the Big Apple, window gates grew on me as I began to understand why they were so popular, and so necessary. NYC wasn't a very safe place in 1970 (though it was never as dangerous as most people seemed to believe), and those half-inch square wrought iron bars made a point. In no uncertain terms they told would-be burglars, "Don't even think about it."

The point was driven home further by a few horror stories from the Times, the News and the Post about children falling out of 10th-story apartments (so did one cat, surviving a fall from the 11th floor, as I recall).

I still wasn't crazy about the cheap safety gates of aluminum or steel alloys that were deemed essential for highrise-dwelling families with children, especially the accordion-fold ones with (illegal) padlocks that blocked access to fire escapes. They're ugly, not particularly secure, easily manipulated by a determined kid, and not at all hard to pry out by a determined burglar.

But wrought iron. What beauty, what quality, what style! Graceful curves accommodate planters bursting with flowers or serve as an elegant encasement for a mundane air conditioner. A delicate fleur-de-lis softens the straight lines of a vertical gate, and crosshatched iron alloys create a diamond-shaped pattern like antique leaded glass. Horizontal white gates recall Venetian blinds rather than prison bars. Even high-security gates with both horizontal and vertical bars painted white can make a plain window look like one with 12-over-12 panes. To me, they're all beautiful.

They're really a city phenomenon, I suppose because city residents feel more vulnerable to crime than most suburban and small-town residents. Their main purpose is to provide security, and the particular value of quality gates like those at Mr. Locks- New York Locksmith company, is that they do it affordably and unobtrusively. In short, they're among the most sensible inventions ever designed to protect people and property. They're a phenomenon worth celebrating.

And, like elegant doors with secure locks, well-designed window gates can also make a statement about the taste and values of the people who live behind them, while providing an unending feast for the eyes of passersby.

While prowling the Internet I found pictures of a wonderful old house in Cuernavaca, Mexico, of a set of gated Moorish arched windows in an outside wall. And of course I familiarized myself with the full range of window gates available at Mr. Locks, Inc., which has one of the most wonderful selections I've ever seen, most of them custom-built to your specifications. If you need to install gates on your windows, as you should, pay Mr. Locks a visit.

I also had what I think is a terrific idea. Everyone has seen the best-selling poster, "The Doors of Dublin," or one of the many knock-offs that followed (The Doors of . . . Brooklyn, Chicago, London, and who knows where else). Imagine a beautifully photographed, handsomely designed and printed poster, "The Windows of New York," showing the five boroughs' incomparable window gates in all their variety and beauty. I bet it would be a best-seller, too.

First Fruit - Jesus Christ Requires All Our First Fruits

The first of everything is for the Lord Jesus. According to Deuteronomy chapter eighteen verses one to five ( Deut., 18:1-5) the children of Israel (Israel) takes care of the Levites, God's priests. One of the ways the nation of Israel achieve this is by presenting the priest with his "due". In part, the "priest's due" consists of the "shoulder," the two "cheeks" and the "maw" of the sacrifice that all the tribes of Israel offer to God.

Secondly, "the first fruit" also constitutes the "priest's due". This include the first fruit of the "fleece" from their sheep, first fruit of their "wine", and "oil".

Finally, the principles of Israel caring for the Levites is similar to the present day church caring for its Pastor. The Lord Jesus institutes this principle so the "man of God" can focus on the Word of God and prayer instead of working to earn an income. Jesus Christ requires all our first fruits.

In our contemporary congregation there is no sacrifice of animals. The sacrifices are "a broken and contrite heart", that is we repent of our sins and surrender our will to Jesus Christ and praise Him with our lips. Not our will, but His Will be done. The first fruit for us may be a bit different from Israel then. In part, first fruit, for us represents each remuneration (pay) or profit or increase that we receive or earn. This is why we give financial offerings and tithe. Our financial giving represents taking care of the "Levites" our Pastor. This is given to the church but in effect we are giving it to God because He commands that we do so. The Lord, Jesus Christ requires all our first fruits. Are you obeying the Lord's command in this area of you Christian life? If not, start today.

The Lord Jesus Christ requires all our first fruits. He wants the first fruit of our time, income, cattle (if we have any), wine, oil, and son. Give all your first fruit to Jesus. Give the first fruit of your time, the first thing you do when you awake each day is to pray and praise and worship Jesus Christ. The first thing you do when you receive new money is to remove your tithe and offering. The first fruit of wine or oil we can literally present (if we have it) to the Pastor, the priest or Levite. This could be anything that we receive or possess that we share with him. Remember the lifestyle of Israel then, is totally different from ours now. So the principle is to share with your Pastor the things God has blessed you with. The first fruit of "your womb" if it is male, give him to Jesus. Dedicate him to God. See Exodus 13:12; 34:19; Numbers 3:12; 18:15. However, let the Elders and the man of God lay hands on all you children(soon after birth) and bless them. "And he took them up in his arms, put his hands upon them, and blessed them." Mark 10:16.

What To Do In New York In 72 Hours

There's so much to do in New York, that you almost don't know what to do with yourself. For many people, taking a short break to New York can seem senseless since it can feel like trying to fit far too many activities into a short space of time. This isn't strictly true if you plan properly and do a little research before you go on your holiday. The amount of activities you try and fit into your holiday will depend on whether you've been to New York before and why you're going to the city this time.

If you are taking a short break to New York and this is your first visit, then the most obvious and popular attractions are where you should head for first. If you enjoy the first holiday there, you can always fly back for another holiday there. The majority of people go to New York to see the sights for which the city is justly famous. The start point for many people is the Empire State building, where a journey up to the upper floors is a must due to the amazing view you can get from up there.

While you're in the neighbourhood, you can always take a quick peek into Macy's so you can see what all the fuss is about on your short break in New York. A short way from there is the beauty of St Patrick's Cathedral with its picturesque old architecture. The contrast between it and the extremely modern skyscrapers is part of the charm of this old church.

The next stop after that on your New York holiday should be a walk along the Brooklyn Bridge. When you have reached Brooklyn a visit to the Brooklyn Museum of Art is highly recommended. It is the second largest collection in New York, but often far less crowded than the better known museums. None of these can be experienced properly without taking sometime to just enjoy your surroundings.

The second day that you're there is often the most laidback since the rush of arriving in New York for your holiday can wear off, leaving you feeling more tired than before. So the best way to start off the day is with a gentle stroll around Central Park just to wake you up and allow you to enjoy the greenery surrounding you. After that you can take a trip to see the most famous lady in the city.

The Statue of Liberty is a must on your first visit to the city, regardless of whether you're taking a short holiday in New York or a very long holiday. The ferry to Staten Island is relaxing and not physically demanding and allows you a fantastic view of the statue while you travel there. While on Staten Island you should have a look at the beautiful Botanical Gardens and the Zoo.

The last day you spend is likely to be a frantic run around to buy souvenirs and gifts before leaving for home. This is a great incentive to have another visit to Macy's before finishing up your New York holiday. You can also visit other landmark stores such as Bloomingdales and FAO Schwartz. Then all you have to do is get all your luggage ready and head off to the airport.

NY Medical Malpractice - fetal distress, anoxia and hypoxia - a case report

Let me tell you about a brain-damaged baby case I handled that started when a woman came to my office and told me about how she was in labor with her second child. She was admitted to the labor floor and apparently hooked up to a fetal monitor to evaluate the baby's heart rate and the mother's contraction patterns.

She was on the labor floor for hours with infrequent visits by a nurse and a resident doctor every so often. Mom told me that despite continued complaints of labor pain, her pleas to help went ignored. Nobody checked on her for more than an hour. When a nurse finally checked in on her, she noted abnormal fetal tracings and ran for the doctor. The doctor came in, examined the patient, reviewed the fetal monitoring strips and decided she needed an emergency cesarean section. All mom knew was that there was a problem with the baby.

At the time of birth, the baby had very low Apgars- the scores that are given to the baby to try and objectively asses the baby's well-being at the time of birth. The doctors look at whether the baby is breathing at birth, whether he's crying, moving his arms and legs. The color of his skin is evaluated, among other important factors that make up a baby's "Apgar scores."

Unfortunately for this mother, her child was deprived of oxygen, a condition known as hypoxia, which is a lack of oxygen, that led to brain damage. We claimed that the baby's distress was visible on the fetal monitor tracing that went ignored, along with mom's complaints. The doctor who was responsible for this patient initially claimed the patient didn't need an emergency c-section, but then later changed his testimony and claimed it really was an emergency c-section because the baby was in distress.

Anoxia is a term doctors use to mean "no oxygen."
Hypoxia is a term doctors use to mean "lack of oxygen."
Either condition is extremely bad for the baby since our brains require oxygen to survive. If the baby's brain is deprived of oxygen of a period of time, the baby can experience permanent and irreversible brain damage.

In our case, I was able to successfully resolve the case in favor of the mother and child. Obtaining appropriate compensation as a result of the failure to recognize fetal distress during delivery allowed mom to be able to support her disabled and brain-damaged child for the remainder of her life.

Fun & Strange Facts About New York City

Reading the SBA Resource Guide for NYC is a great way to become familiar with state regulations and local agency contact information for all five boroughs and the surrounding counties.

The state income tax rate ranges from 4.0% to 7.7%, and the local income tax rate ranges from 2.907% to 4.45%. The state sales tax rate is 4%, and the local sales tax rate is 4.375%.

According to city-data.com, the five largest employers in the NYC area are the City of New York (by far), the New York Public Schools, Merrill Lynch, JFK International Airport, and the Goldman Sachs Group.

The climate can be hot and humid in the summer and freezing cold in the winter, with the possibility of every variation of weather in the spring and fall.

New York City is actually made up of five separate counties, or boroughs: Queens (Queens County), Brooklyn (Kings County), the Bronx (Bronx County), Staten Island (Richmond County), and Manhattan (New York County).

TRADITIONS

The city's street vendors are part of local culture. Almost everyone agrees that this is a fine way to get good, inexpensive food quickly.

The annual Easter Parade is probably more about clothes than about Easter, since its unusual hats and costumes are what distinguishes this parade from any other.

Every once in a while, New Yorkers decide that a momentous occasion deserves a ticker tape parade. The "ticker tape" comes from the leftover stock ticker tape that was used as an impromptu substitute for confetti when they decided to celebrate the dedication of the Statue of Liberty. People don't use stock tickers or the ticker tape anymore, but the name stuck, and now refers to any parade down a major New York City street with confetti thrown in celebration of the occasion.

SPORTS

NFL Football: New York Giants (at Giants Stadium in East Rutherford, NJ)
NBA Basketball: New York Knicks (at Madison Square Garden in Manhattan, NY)
MLB Baseball: New York Mets (at Shea Stadium/Citi Field in Flushing, NY) and New York Yankees (at Yankee Stadium in Bronx, NY)
NHL Hockey: New York Rangers (at Madison Square Garden in Manhattan, NY)
MLS Soccer: New York Red Bulls (at Giants Stadium in East Rutherford, NJ)

If conversation is at a lull, and you are with a baseball fan or two, get them to tell you the history of baseball stadiums in New York. From a good storyteller, you can hear all about Ebbets Field, the emigration of the Brooklyn Dodgers, and the end of an era at Yankee Stadium.

TRIVIA

The corner of 54th Street and Broadway is called "Big Apple Corner" because that's where the gentleman who coined the term "Big Apple" used to live. A 1997 city ordinance says so.

Residents of Staten Island (Richmond County) had once voted to secede from New York City, but the state of New York required that the city be given veto power over the vote. The city's mayor didn't want to disrupt the budget or the city services, so he denied Staten Island's request.

Legend has it that Peter Minuit purchased the entire island of Manhattan from the Algonquin Indians for the equivalent of $24.00 USD in 1626.

Jean-Michel Basquiat - The Neo-Expressionist & Graffiti Milestone!

Jean-Michel Basquiat was a great artist, born in Brooklyn, the New York City on December 22, 1960. His father, Gerard Jean-Baptiste, a Haitian, was a former Haitian minister of interiors. His mother, Matilde, was from Puerto Rica. Jean was a very intelligent kid since childhood and had strong inclination for language and literature. Moreover, owing to his "multinational" parents, he was very fluent in English, Spanish, & French, and used to read history, medical texts, poetry, mythology, etc.

Since his childhood, Jean had an interest in art. Michel's mother noticed this. Knowing his interest and keenness, she encouraged her child to paint and draw. At the age of seventeen, in 1977, Michel, along with his friend, Al Diaz, started spray painting graffiti in Manhattan and on the subways. Jean-Michel and his friend would sign their works with "SAMO'. In December 1978, the Village Voice, New York's weekly newspaper, carried an article on SAMO messages. SAMO phase ended with the declaration "SAMO IS DEAD" on the walls of SoHo buildings.

In 1978, just a year before his graduation from school, Jean left home and dropped out of school. He started living with his friends, and would sell T-shirts and painted postcards on the city streets for his livelihood. By the year 1979, he had become quite famous, as he was regular on Glenn O'Brien's show, TV Party. In June 1980, Jean-Michel's paintings were exhibited for the first time at the Times Square Show, along with the artworks of David Hammons, Mimi Gross, Mike Glier, Robin Winters, Jane Dickson, Lee Quinones, Kenny Scharf, Kiki Smith, and Jenny Holzer. After this exhibition, Jean started exhibiting his art in Europe and around the New York City. He also worked with great painters such as Barbara Kruger and Keith Haring. 1980s was the era, when Jean-Michel Basquiat gained popularity as a Neo-expressionist.

Apart from forming a band with the musician and actor Vincent Gallo in the late 1970s, Jean-Michel Basquiat also acted in a movie. His band was named Gray, which played in the clubs. In 1981, the first major article titled, "The Radiant Child," was published on Jean, in the magazine, Artforum. Artist and poet, Rene Richards, wrote the article. This helped give Jean's career a big leap to the international level. 1980-82, Basquiat's canvass adorned "mortality" as the theme reflected through skeletons and faces.

Jean-Michel Basquiat continued showing his work alongside the likes of Francesco Clemente, David Salle, and Enzo Cucchi. In the fall 1982, he began dating Madonna, an aspiring performer. Nearly the same year, he befriended the artists, Andy Warhol and David Bowes. He traveled through Africa and an exhibition of his work was held in Ivory Coast. Later, a large exhibition was also held displaying more than sixty paintings and drawings at Kestner-Gesellschaft. At that time, he was the youngest artist there to exhibit his work. In 1988, Jean had an exhibition in both, New York and Paris. The art display in New York received high praises.

By 1984, Jean had started taking drugs and developed an addiction for heroine. Owing drug abuse, he suffered from paranoia and erratic behavior. 1982-85, Jean Basquiat's paintings graduated to multipanel level, stretcher bars displaying, collage, and scribbles. The death of Andy Warhol in 1987 took its toll on Jean-Michel Basquiat, and his drug addiction symptoms augmented. He tried hard to get rid of his heroine habit. He left for Hawaii and returned claiming he had recovered from the drug addiction. On August 12, 1988 though, at the age of 27, Jean died of drug overdose. Though no more around, but Jean, through his paintings, continues to inspire the modern artists such as Mark Gonzales, Kelly D. Williams, Chinghalle, and Raymond Morris.

Lost Souls Found By Kyla Duffy And Lowrey Mumford

In this book, you find over 30 short accounts of people who have a rescued Boston Terrier. Some stories are fun and some serious. Several stories relate the awful thing about "puppy mills" and what happens to dogs there where they are used to breed purebred dogs and then they either die, or are abandoned or worse, once they are no longer of any use to the people who run these awful places. Many of the stories are heartwarming and funny. All in all, the stories give people the idea of how wonderful these little dogs are and how important it is that everyone remembers that there are so many dogs that need to be rescued and adopted.

One of the stories, "Eyes Only For You", tells about how an owner connects with his rescue dog just from the friendly eyes he sees when he meets her. In a sad story with a happy ending "Foster Failure" tells of a dog that nobody wanted and was taken in at a foster puppy home only to find the foster parents fell in love with the dog and wound up adopting him. This family gave a home to the poor dog who had lived such an awful life in a puppy mill. A few pages such as "A Snort Break" give a few sentences telling happy tails or funny moments about different Terriers.

I believe that a book like this would open any one's eyes to the importance of choosing a rescue dog when the opportunity arises. As different books on different breeds are written and read, I imagine even more breeds of dogs will be better off and more dogs adopted. Perhaps you might have a rescue dog story of your own or may want to adopt a rescue dog after reading about these great animals and all they go through.
